1. Definition of Terms

1.1 “we, us, our” refer to The Edinburgh Casting Studio

1.2 “you, your” refer to the person who uses or purchases any of our services, website, content, intellectual property or products

1.3 “our website” refers to www.edinburghcasting.com

1.4 “product/s” refers to any materials, kits or other products or services purchased from us.

1.5 We provide a range of services and products including Body Casting Service, Body Casting Kits, and Body Casting Training from our studio in Edinburgh. We operate from 41 Montrose Terrace, Edinburgh, Scotland, EH7 5DJ.

2. Copyright and Intellectual Property

2.1 All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on our website, (including that provided or transmitted by a third party or service, including but not limited to Google, Facebook & Instagram), in promotional materials, packaging, receipts and all other associated literature, belong to The Edinburgh Casting Studio.

2.2 The Edinburgh Casting Studio reserves all of its rights. Nothing in the Terms grants you a right or licence to use any trade mark, design right or copyright owned or controlled by us unless expressly provided in writing.

3. Limitation of Liability

3.1 The Edinburgh Casting Studio does not accept liability for any damage to property of possession, loss of earnings, lost profits, or incidental, indirect, special or consequential damages, arising out of your use or inability to use our products, even if we have been advised of the possibility of such damagers. This applies to all products and services rendered by The Edinburgh Casting Studio, in person or otherwise.

3.2 We always recommend conducting a test (or patch test) when using a product for the first time. The customer must take responsibility for protecting clothing, work area and surfaces to avoid damage from using any product, and follow safety precautions listed on materials, kit guide books and all associated literature or online guidance. Our products are not toys, and must be used by adults only. Children should be supervised at all times by an adult.

4. Pricing

4.1 All products are listed in prices for GBP £ Sterling, and include UK VAT. We reserve the right to change the prices listed for products or postage at anytime. Promotions and discounts are limited to stock availability to each item.

4.2 Any quoted prices by email or telephone are valid for 24 hours.

5. Purchase of Goods

5.1 Orders, Contracts and Stock

5.1.1 We can only accept orders from customers 18 years of age or older. Once you have paid for items via the checkout process, your will receive a confirmation email. From the point of payment, a contract exists between The Edinburgh Casting Studio and the purchaser. Our Terms and Conditions are accessible online at the bottom of each page and we assume you agree to be bound by these at point of purchase. Until the item is shipped to the customer, either party may decline to proceed with the order and request a refund if the decision to not proceed is taken.

5.1.2 If an error occurs relating to stock or pricing, The Edinburgh Casting Studio are not obliged to supply the goods at the price stated and will instead cancel the order and refund in full or recommend alternative items.
All items listed online are subject to stock availability. During busy periods (such as but not limited to: Christmas, Mothers/Fathers Day), The Edinburgh Casting Studio may sell out of an item and are not obliged to fulfil the order, and will instead offer alternative items or a refund.

5.2 Delivery

5.2.1 Delivery services are offered as you checkout and estimates of delivery dates are provided on the delivery page. The delivery costs are based on the total approximate packed weight and/or volume of the items in your basket. Delivery dates are approximate and not guaranteed.  If you need your goods for a tight deadline please choose Express delivery if offered. Express delivery is offered at the discretion of The Edinburgh Casting Studio and may not always be available.

5.2.2 Any free delivery deals are offered at our sole discretion and may be withdrawn at any time without notice. Free delivery is offered for online purchases only, and may be limited to or may exclude specific geographical areas, (for example, ‘remote areas’ as deemed by us or the courier service)

5.2.3 Allow more time at peak periods (eg Christmas) for deliveries. You will be alerted to any known delays in dispatch time, at the time of purchase. For items sent outside the UK, any customs duties applicable, local/state taxes, or other import duties are the sole responsibility of the buyer and not payable by The Edinburgh Casting Studio. Please note we are not liable for any losses experienced due to an order arriving after the estimated delivery date.

5.2.4 If you have not received your item, a claim of non-receipt must be made by email within 28 days of noted dispatch date.

5.3 Non-delivery Surcharges

5.3.1 In the event of attempted delivery of an item the courier, a card will be left if the courier was unable to reach you. It is your responsibility as the customer to make contact with the courier to rearrange your delivery within the time stated on the calling card.  Contact must be made at the earliest opportunity to avoid the parcel being returned to us unclaimed as this may result in redelivery charges being applied to your order.

5.3.2 Incorrect delivery details may lead to delays in the delivery of your goods, so before placing your order, please ensure that you have included the full Delivery address details, including accurate postcode of the intended recipient and your daytime contact telephone number in the event that any delivery problems are encountered. If you give us an incorrect address/postcode or missing parts to an address and the parcel goes missing, The Edinburgh Casting Studio will not be held responsible.

5.4 Refund

5.4.1 To request a refund, please contact us here before your item has been dispatched. If you are able to contact us before dispatch, your item will be refunded in full. Refunds are made at the discretion of The Edinburgh Casting Studio, to the payment method shown on purchase receipt.

5.4.2 In the case that your order has been dispatched and you have received your item but have changed your mind, you can cancel your order within 14 days of receiving your item. In this case please contact The Edinburgh Casting Studio where you will be advised on the return process. Any goods to be returned must be in saleable condition, and unopened. Any items that are returned unopened and in fully saleable condition within 28 days of receiving your item are eligible for a full refund of original product costs.

5.4.3 The buyer must cover cost of return postage charges, and is advised to keep a proof of postage for your records. Using a recorded delivery service is recommended, for the buyers protection. The buyer has the duty of reasonable care when returning goods to ensure they are repackaged well and will arrive in a re-saleable condition. If the items are returned from the buyer and have been damaged in this return, but can be repackaged/relabelled and resold, a repacking fee will be charged.

5.4.4 If a discounted item is returned for refund, the price charged on the customer’s invoice will be processed.
All items pass a thorough quality check before dispatch, to ensure satisfaction. If your item arrives damaged, please notify The Edinburgh Casting Studio by 2pm the following day, so we can raise a claim with our courier. The Edinburgh Casting Studio may ask for digital photographs of your item so they can understand any damage/fault. If an incorrect item was sent, return postage will be refunded and a replacement sent.

5.4.5 When contacting us with a request for a refund, please include the following details:
– Your full name and address
– Item purchased
– Reason for return
– Payment method
– Photo of damaged goods (if applicable)
– Purchase date and order reference

6. Body Casting Service

6.1 Commission of Body Casting Services

6.1.1 We provide an in person Body Casting service and in every case will endeavour to make the casting agreed at the time of booking. We reserve the right to offer alternative arrangements, should the agreed casting style prove unsuitable. Circumstances in which we may offer alternative casting styles include (but are not limited to) health conditions or illness, young children and babies.

6.1.2 We create a comfortable and safe environment in which to have a casting made, with many customers visiting us from around the world. Due to the nature of the body casting process, close contact is required in order to create a high quality sculpture. By agreeing to our terms, you confirm your understanding that close contact may be required. This will also be discussed at your casting session.

6.1.3 Should you become uncomfortable at any time during the casting session, we are able to stop immediately at your request. Should this occur, this will incur a surcharge to cover time and materials.

6.1.4 The materials we use are very safe, but should you have any allergies, disabilities or illnesses that we should be aware of, please inform us within 24 hours of booking. Should an appointment need to be cancelled in light of information given after this period, no refund of any deposit will be given.

6.2 Booking and Payment

6.2.1 All bookings must be secured at least 2 weeks in advance of the desired appointment date as we cannot guarantee spaces will be available at short notice. When booking with a voucher, the appointment must fall before the expiry date detailed, and must be booked at least two weeks before the voucher expires.

6.2.2 We take a deposit to secure your booking appointment. This can be paid over the phone or via email using Paypal. We accept payments from most Debit and Credit cards (excluding American Express). We do not store card details. Once a deposit is paid, you secure a casting appointment at an agreed date, time and price.

6.2.3 The deposit paid is non-refundable in the case of a cancellation, but we are able to rearrange a casting appointment given 2 weeks’ notice. As your appointment space is reserved specifically for you, no alterations to the date or time will be permitted without the stated 2 weeks’ notice. At our discretion, we may allow one rearrangement which must fall within 4 weeks of your original booking date. Further changes to your booking date/time will be treated as a cancellation, forfeiting your deposit. The Edinburgh Casting Studio is unable to offer refunds or rearrangements for cancellations due to circumstances out of their control, including but not limited to: Unfortunate/unexpected weather conditions, Illness, Strike action, Transport problems, or major world/political incidents and problems.

6.2.4 Please note that very rarely we may need to change the date or time of your booking. In the unlikely circumstance that this occurs, we will contact you to ensure we choose a convenient replacement appointment for you. No refund of the deposit will be given, but will be transferred to the new date chosen (within 6 weeks of your original booking). We cannot be held responsible for any other losses that may occur as a result of the changed booking.

6.2.5 During busy periods, we may request a larger deposit to secure your booking. Busy periods may include (but are not limited to) Bank Holiday Weekends, National Holidays, School Holidays, Festive Periods, Saturday Appointments and Festival Periods. Appointments that require more than one booking slot will require a larger deposit.

6.2.6 The balance due for your casting will be paid at your casting session (minus deposit paid) at our studio. We accept cash and card payments. We cannot accept cheques, BACS, or payment upon collection.

6.2.7 You will be notified once your casting is complete via email. We require that you collect your casting within 3 months of completion unless agreed otherwise. We cannot be held responsible for any loss or damage that may occur after this period.

6.3 Body Casting Shipping, Collection and Delivery (Specific to Body Casting Service)

6.3.1 We provide a worldwide packing and shipping service for Body Castings made at The Edinburgh Casting Studio. Castings are not insured against damage, as the materials we use to create our sculptures are exempted from insurance by our carriers. However, castings are insured against loss, up to the maximum allowable by the courier per item (usually £250. May be subject to change). If you have not received your item, a claim of non-receipt must be made by email within 28 days of noted dispatch date.

6.3.2 Please be aware that castings are shipped at your own risk, and no compensation for damage can be provided due to limitations on insurance provided by couriers. By agreeing to our terms, you confirm your understanding of this, should you require a courier. Should you wish to arrange your own collection via courier, a packing and admin fee will be due. The Edinburgh Casting Studio accepts no responsibility for loss or damage of the parcel or its contents once collected by your chosen courier.

6.4.3 Body Castings and other products related to our body casting service are not eligible for free delivery. Body Castings require a different courier service, and will be charged separately. Delivery cost varies for each piece, and will depend on a number of variables including but not limited to: size, weight, complexity and specialist packing requirements.

7. Vouchers

7.1 Vouchers sold on our website are downloadable and will be sent automatically via email. They are not sent physically. All gift vouchers are non-returnable and non-refundable and may not be redeemed for cash. All gift vouchers expire on the date detailed on the voucher, and may not be used to book an appointment or pay for a casting thereafter. They may be redeemed only against the item/booking/experience stated, all exchanges are at the discretion of The Edinburgh Casting Studio and may not be offered. In order to maintain a fair service to customers, no extensions to voucher expiry dates will be granted under any circumstances.

7.2 For services with age limits, some vouchers may not be valid. Should the participants of the casting session be too old/young The Edinburgh Casting Studio may offer an alternative. In the case where this alternative exceeds the value of the gift voucher, additional payment would be due.

7.3 Bookings made with vouchers are subject to our full terms and conditions. Should a voucher booking need rescheduling within two weeks of the appointment, our standard non-refundable deposit would be due to secure a future space.

8. Statutory Rights

8.1 These terms do not affect your statutory rights.
